A central element of the social contract for thousands of years, water was one of the first elements of nature to be regulated from the very first human societies. Although experiences are different according to historical, cultural, hydro-geographical contexts, common elements can be noticed throughout the ages and continents. In the context of the (re)construction of a water law in New Caledonia, it seemed interesting to us to look at the legal systems around water, sacred, respected, non-appropriated, and those based on property rights mainly derived from Roman law, from a historical perspective.
