Le positivisme comme le jusnaturalisme confèrent aux théories juridiques un statut épistémologique a priori indépendamment de leurs contenus. L’élaboration d’une pratique scientifique juridique conduit à reconsidérer la fonction assignée aux théories. La formulation de théories juridiques et leur confrontation avec la réalité normative afin de tester leur validité constituent, en l’état de nos connaissances, l’unique possibilité d’appro¬che objective du phénomène juridique. La réalisation de ces tests empi¬riques nécessite l’élaboration de langages spécifiques et de règles prati¬ques conformément aux apports respectifs de la sémantique scientifique et du rationalisme critique.

The Epistemological Status of Juridical Theories : An Essay on the Definition of Juridical Scientific PracticePositivism as a natural law attributes to juridical theories an a priori epistemological status independently of their contents. The elaboration of a juridical scientific practice leads to reconsidering the function assigned to theories. The formulation of juridical theories and their confrontation with normative reality for testing their validity constitute, considering our present knowledge, the only possibility of an objective approach to juridical phenomenon. The realisation of these empirical tests requires the elaboration of specific languages and practical rules in accordance with the respective contributions of scientific semantics and critical rationalism.
