Montlosier offers a radical critique of the Declaration of the Rights of Man and of the Citizen of 1789, which he considers incoherent, poorly drafted, and based on philosophical abstractions disconnected from social and political reality. In his view, the Constituent Assembly failed by adopting a flawed method of reasoning—relying on an overly theoretical conception of man in the state of nature, lacking the necessary rigor, and neglecting the historical and political foundations of rights.Yet Montlosier does not reject the very principle of a declaration of rights. On the contrary, he proposes his own rational declaration, grounded in a realistic analysis of society and history, designed to serve as a coherent foundation for a political constitution. In doing so, he affirms his desire to reform and root human rights in a solid political perspective rather than in abstract ideals.

Montlosier critique radicalement la Déclaration des droits de l’homme et du citoyen de 1789, qu’il juge incohérente, mal rédigée et fondée sur des abstractions philosophiques déconnectées de la réalité sociale et politique.
