The accidental smothering of infants between the sixteenth and seventeenth century through the case of the diocese of Jesi

L’article analyse la question de l’étouffement accidentel des nourrissons entre le xvie et le xviie siècle à partir des documents produits par le tribunal de l’évêque de Jesi, dans la région des Marches en Italie, en commençant par une évaluation de l’historiographie consacrée au sujet et en développant ensuite un examen approfondi des positions des juristes contemporains, laïques et ecclésiastiques, pour arriver à la documentation du tribunal. Cette documentation est composée d’un certain nombre de suppliques présentées par les parents des nourrissons décédés à l’évêque afin d’obtenir l’absolution. Par ces différentes étapes, la contribution vise à définir la nature de l’étouffement, considéré par l’Église comme un péché et non un crime et donc jugé et absout par la Cour au moyen de pénitences, dans une tentative de maintenir l’ordre social et la paix des communautés.

The article analyses the issue of the accidental smothering of infants between the sixteenth and seventeenth century using the documents produced by the Bishop’s Court of Jesi, in the region of the Marches in Italia. Starting with an assessment of the historiography dedicated to the topic, we then develop a thorough examination of the positions of the contemporary jurists, both lay and ecclesiastical, before studying the documentation of the court. This documentation specifically consists of a number of requests of pardon presented by the parents of the deceased infants to the Bishop in order to obtain an absolution. Through these successive steps, the contribution intends to assess the nature of the smothering, considered by the Church as a sin and not a crime and therefore absolved by the Court through penances, in the attempt of keeping the social order and the peace of the communities.
