La justice est aveugle : Rawls, Harsanyi et le voile d'ignorance

L’article soutient que l’impartialité conçue comme ignorance est un premier pas, nécessaire mais insuffisant, vers la justice sociale. Il montre la pertinence de placer l’évaluateur social sous un voile d’ignorance : ses jugements sont alors soumis au principe moral d’universalisation, lequel en garantit l’impartialité. Mais la modélisation de l’impartialité diffère selon que l’on interprète de manière kantienne ou utilitariste le principe sous-jacent d’universalisation. L’article compare le modèle utilitariste de l’observateur impartial de Harsanyi au modèle kantien de l’observateur ignorant de Gajdos et Kandil. Il défend ce dernier, lequel prouve que, contrairement à ce que prétendait Rawls, le critère de choix sous voile d’ignorance n’est pas univoque.

Rawls, Harsanyi and the veil of ignoranceThe paper shows that, when dealing with social justice, it is necessary but not sufficient to consider the social evaluator as placed behind a veil of ignorance. Then, her judgements are conform to the moral principle of universalisation and thus are impartial. But the way such judgements should be modelled depends on the interpretation, whether utilitarian or Kantian, given to the universalisation principle. The article compares the utilitarian model of the impartial observer from Harsanyi with the Kantian model of the ignorant observer from Gajdos and Kandil. It defends the latter, which shows that, differently to what Rawls claimed, the maximin is not the unique rule of decision under ignorance.Classification JEL : B41, D60, D63
