Gender mainstreaming : Une approche trop quantifiée ? Une analyse au départ du droit fédéral belge

À partir du milieu des années 90, les différents États ont pris conscience de la nécessité d’intégrer la dimension de genre au sein de toutes les politiques publiques. Pour ce faire, chaque État a eu une marge de manœuvre très large pour instituer cette approche. En Belgique, et en particulier au niveau fédéral, plusieurs instruments ont été développés pour réaliser cet objectif. Cette contribution revient sur une partie de ces instruments et analyse la manière dont ils sont instaurés et puis implémentés. Nous chercherons à démontrer que le droit encadrant ces outils favorise tendanciellement une dimension chiffrée du gender mainstreaming. Nous considèrerons les forces et les faiblesses d’une telle logique de rationalisation pour pouvoir répondre à la question suivante : le gender mainstreaming relève-t-il d’une approche trop quantifiée en droit fédéral belge ?

From the mid-1990s onwards, the States became aware of the need to integrate the gender dimension into all public policies. To do this, each State had a very wide margin of appreciation to institute this approach. In Belgium, and particularly at federal level, a number of instruments have been developed to achieve this objective. This contribution looks at some of these instruments and analyses the way in which they are introduced and then implemented. We will seek to demonstrate that the law governing these tools tends to favour a quantified dimension of gender mainstreaming. We will consider the strengths and weaknesses of this rationalisation in order to answer the following question : is gender mainstreaming too quantified an approach in Belgian federal law ?
