La place de la philosophie du droit à l’IES : un compromis entre droit et morale

Due to the specificities that led to its creation, the ISS within the Theologicum of the CUP adopted an original conception of the Teaching of Law, strongly inspired by Natural Law. If the different teachers adopted a generally similar approach, the CUP appears to be the place of a residual but resistant conception of the Teaching of Law. Inspired by Leo XIII, this conception in fact values a philosophical approach to Law, which considers Law and Morality irremediably associated. In a social context of secularization of society, this conception appears as a form of exoticism. However, the Teaching of Natural Law would be the responsibility above all of the private universities, in a context of regression of Natural Law.

En raison des spécificités qui ont présidé à sa création, l’IES au sein du Theologicum de l’ICP a adopté une conception originale de l’enseignement du droit, fortement inspirée du droit naturel. Si les différents enseignants ont adopté une approche globalement similaire, l’ICP apparaît comme le lieu d’une conception résiduelle mais résistante de l’enseignement du droit. Inspirée par Léon XIII, cette conception valorise en effet une approche philosophique du droit, qui considère le droit et la morale irrémédiablement associés. Dans un contexte social de sécularisation de la société, cette conception apparaît comme une forme d’exotisme. Toutefois, l’enseignement du droit naturel incomberait avant tout aux facultés libres, dans un contexte de régression du droit naturel.
