The ethics of discourse (Apel, Habermas), far from being purely formal, conveys a substantial conception of justice. This is not because the communicative action would anticipate an « ideal form of life », but because it implies « principles of justice » which are not merely distributive but demand the material and cultural conditions of free and equal participation of everyone in the discursive order.
