L’objet du présent article est de présenter l’Obligation réelle environnementale (ORE), comme un instrument permettant de mettre la propriété privée au service de la préservation d’un bien commun, et plus particulièrement l’environnement en tant que patrimoine commun de la nation. À cet effet, il s’agira d’envisager l’ORE comme un instrument du droit des communs permettant de définir le droit à la contribution de ses biens au service de la préservation du bien commun. Une telle contribution repense les relations des citoyens contributeurs avec l’administration dans la mise en œuvre des politiques publiques. Également, elle permet d’affecter et de limiter ses droits de propriété pour assurer la mise en commun. Par ailleurs, il s’agira d’envisager l’ORE comme un outil exorbitant du droit commun capable d’œuvrer à la préservation de la chose commune. Une telle dérogation permet à l’administration d’accompagner le propriétaire et remet en perspective la définition établie portant sur le régime des contrats administratifs.

The purpose of this article is to present the Obligation réelle environnementale (ORE) (which is the French expression used to describe a conservation easement), as an instrument making it possible to put private property at the service of the preservation of a common good, and more particularly the Environment as a common heritage of the nation. To this end, it will be a question of considering the ORE as an instrument of the law of the Commons making it possible to define the right to the contribution of its goods in the service of the preservation of the common good. Such a contribution rethinks the relations of citizen contributors with the administration in the implementation of public policies. Also, it makes it possible to affect and limit its property rights to ensure pooling. Moreover, it will be a question of considering the ORE as an exorbitant tool of common law capable of working to preserve the common thing. Such a derogation allows the administration to support the owner and puts into perspective the established definition relating to the system of administrative contracts.
