La procédure de création d’ une colonie est sans doute plus longue et plus complexe qu’ on ne l’ imagine quand on la réduit à une date de «fondation » ou à une mise en série. Les langues modernes ne distinguent d’ ailleurs pas la fondation de la ville, comme fait urbain, et la constitution institutionnelle d’ une collectivité politique, alors que le vocabulaire latin établit d’ importantes nuances. On remarque en effet que le latin distingue bien urbem (oppidum) condere et coloniam deducere. Or, ces deux verbes sont loin d’ être des synonymes. L’ analyse lexicale, étendue aux récits en langue grecque (avec un lexique fondamentalement différent) permet ainsi de remettre en question les schémas issus du préjugé selon lequel les colonies sont des répliques de Rome, «fondées » selon le rituel varronien du sulcus primigenius, alors même que le contexte de création des colonies est très différent de la fondation mythique de Rome par Romulus. Certes, il semble indispensable de fonder une ville qu’ on destine à l’ établissement d’ une colonie, mais seulement lorsque la ville n’ existe pas déjà. En outre, ce rituel ne semble pas avoir une grande importance dans la procédure coloniale. On peut même supposer qu’il relève de la compétence des imperatores, alors que l’établissement d’ une colonie requiert une procédure institutionnelle lourde, impliquant le vote d’une loi. Ce résultat permet de poser à frais nouveaux la question de ces cités aux statuts tant discutés, fondées par des imperatores dans leurs provinces, sans décision politique préalable connue. L’ acte le plus important semble bien être en fait la deductio, conclusion d’une longue procédure, considérée apparemment comme date de début d’existence de la colonie. La confrontation de l’analyse du déroulement de la fondation et des célèbres inscriptions d’Aquilée et d’Vrso permet de comprendre la manière dont on devient citoyen d’ une colonie, tout en expliquant la durée relativement longue du mandat des triumvirs. Enfin, l’ étude des diverses procédures adoptées pour les renforcements de colonies montre que les institutions prennent en compte la variété des situations concrètes.
