Les lois de saint Óláf, roi de Norvège de 1015 à 1028, forment un lieu commun des sources islandaises et norvégiennes du Moyen Âge. Elles ne se laissent pas aisément saisir cependant, tant elles se situent à la charnière du droit et du mythe. Probablement inventées au cours de la première moitié du xie siècle pour accompagner la légende du saint roi, elles sont devenues, à compter du milieu du siècle suivant, la pierre angulaire du droit norvégien, jusqu’à nourrir l’émergence des lois fondamentales du Royaume de Norvège. Cette étude se propose donc de cerner l’origine et la portée de ce mythe juridique, à l’aube d’un constitutionnalisme naissant.

The laws of Saint Óláf, king of Norway from 1015 to 1028, form a pattern of the Icelandic and Norwegian sources of the Middle Ages. They are not easily understood, however, as they are at the crossroads of myth and law. Probably invented during the first half of the eleventh century to accompany the legend of the holy king, they became, from the middle of the following century, the cornerstone of Norwegian law, shaping and informing the emergence of the fundamental laws of the kingdom of Norway. The purpose of this study is to understand the origin and scope of this legal myth, at the dawn of a nascent constitutionalism.
