L’article examine un procès criminel qui eut lieu dans la capitale du gouvernement de Cuyo, en 1818, au cours des guerres d’indépendance hispano-américaines, avec l’intention de l’analyser comme une pratique judiciaire, source privilégiée pour examiner la pluralité normative et procédurale alors en vigueur et les procédures pénales inquisitoires mises en œuvre, objets du débat historiographique contemporain. L’exercice spécifique de la preuve et les arguments qui ont légitimé la condamnation sont également analysés. En l’absence d’un centre de pouvoir unifié, ce cas de sédition permet de mettre en lumière une mutation de la culture politique, où patriotisme et vertu républicaine deviennent prépondérants, au détriment de la tradition monarchique.
