Résumé
A thriving ecosystem is being built around Web3 and NFTs, which are poised to increase in importance across a wide range of fields and mainly in the legal industry. The open nature of these new concepts supports the establishment of new forms of property, such as digital property, that can provide new sources of revenue. However, how can the digital rights traded be understood and protected? What is the alternative to “code is law”? Incorporating a metaverse clause and an informed consent clause into the smart contract may be the answer to making this right enforceable and interoperable across various metaverses.
