C’est à partir d’une réflexion sur la guerre au xixe siècle que s’ouvre l’idée d’un droit international humanitaire qui précède la pensée d’un droit international. Après la Première Guerre mondiale, il est proposé la création d’un tribunal pénal international, afin de juger les principaux responsables des crimes commis en violation des lois et coutumes de la guerre. Mais c’est à Nuremberg, après la Seconde Guerre mondiale, qu’une juridiction militaire internationale consacrera la répression des crimes du droit des gens et établira la distinction entre les crimes contre l’humanité et les génocides.

It was from a reflection on war in the 19th century that the idea began to emerge of international humanitarian law, which would be the forerunner to thinking on international criminal law. After the First World War, there was a proposal to set up an international criminal court to judge those held responsible for crimes committed in violation of the laws and customs of war. But, it was at Nuremberg after the Second World War that an international military court would first punish crimes against international law and establish the distinction between crimes against humanity and genocide.
