The present paper is the extended version of a shorter contribution to a celebratory volume dedicated to Rik Castelain, president of the Historical Society of Oudenaarde (Belgium). Three aspects are examined: current evolutions in the field of legal history (I), the conceptualisation of territory and jurisdiction in eighteenth-century law of nations literature (with an emphasis on analogies with civil law (real property/obligations) (II) and the application of this conceptual framework to a territorial dispute (III) involving the Kingdom of France and Emperor Charles VI of the Holy Roman Empire as Count of Flanders, ruler of Tournai and Count of Hainault, in the aftermath of the Peace Treaties of Utrecht (1713), Rastatt and Baden (1714). The contribution leans on published doctrine, treaty collections and handwritten archival sources from the French Ministry of Europe and Foreign Affairs (series Mémoires & Documents – France).
