Le 1er octobre, la CEDH se prononçait pour la première fois sur la conventionnalité des conditions posées par la loi française au bénéfice des prestations familiales pour les étrangers. La position adoptée par les juges européens devrait satisfaire ceux qui pensent nécessaire de limiter l’accès des familles étrangères à la protection sociale ; d’autres y verront une nouvelle preuve de la bienveillance de la Cour à l’égard des politiques migratoires, les règles en cause étant davantage à leurs yeux un outil de limitation de l’immigration qu’un instrument de protection de la famille.

Family allowances and non-respect of family reunification: french law judged to be in compliance with the conventionOn 1 October the ECHR for the first time made a pronouncement about the compliance with the convention of the conditions laid down by French law concerning family allowances for foreigners. The position adopted by the European judges should satisfy those who think it is necessary to limit access of foreign families to social benefits; others will see in it further proof of the benevolence of the Court with respect to migratory policies, as the rules in question are, in their eyes, more a tool to limit immigration than an instrument of family protection.
