Legal historians are interested in military matters. But their studies are divided into different branches of law. To increase their visibility among jurists and historians, we aim to bring them together under the concept of history of military law. After defining this discipline in the introduction, we will present an outcome of the relevant research and lessons. The former will be analyzed on the basis of a census and classification of the theses of legal history prestened since the 19th century. The latter will be exposed through a survey of textbooks on the history of institutions and international law from the past century, as well as a survey of colleagues. As the title suggests, this record is not definitive. It will deserve to be completed in the future according to various ways of research mentioned in the conclusion

Si les questions militaires n’échappent pas aux historiens du droit, leur étude est répartie dans différentes branches du droit. Pour augmenter leur visibilité auprès des juristes et des historiens, on propose de les réunir sous l’étiquette d’histoire du droit militaire. Après avoir défini cette matière dans l’introduction, on présentera un bilan des recherches et des enseignements pertinents. Les premières seront analysées à partir d’un recensement et d’une classification des thèses d’histoire du droit soutenues depuis le XIXe siècle. Les seconds seront exposés à l’aide d’un sondage dans les manuels d’histoire des institutions et du droit international du siècle passé, ainsi que d’une enquête menée auprès de collègues actuellement en poste. Ce bilan nuancé n’est pas, comme son titre l’indique, définitif. Il méritera d'être complétée à l’avenir selon différentes pistes de recherche évoquées en conclusion.
