The author maintains that the state of emergency is the situation where the competent authority decides to consider as a state of emergency and which involves a suspension of rights but is always defined and configured by law; it always means the application of a legal framework that replaces another in accordance with what is established in a higher legal norm. This is the conclusion that emerges from the analysis of French positive law, thus answering the theory of Giorgio Agamben, according to which it is during exceptionality - and not in periods of normality - that one could perceive and analyze the very essence of political power.
