L’apparato illustrativo del corpus iuris civilis. Dall’analisi di un corpus di manoscritti ora alla BnF

This contribution analyses the illustrations of the Corpus iuris civilis found in a group of manuscripts now preserved in the BnF's Latin collection and new Latin acquisitions. This corpus comprises approximately forty manuscripts illuminated around the 13th and 14th centuries in northern Italy, southern France and Catalonia. The contribution is therefore part of the field of research dedicated to legal iconography - 'the Art of Law' - a field of discipline that art historians have so far been mainly concerned with.The examination of this apparatus of illustrations from a legal point of view shows how images can be attributed multiple functions. Indeed, they are not limited to decorating the text or constituting a useful 'visual index' structuring the corpus iuris, enabling the reader to orientate himself between the different books that compose it. On the one hand, in fact, the images contribute to the "sacralisation" of the jurist, reflecting the prominent role he had come to play in the society of the time. On the other, by concretising the verbal abstraction of the norm, the images constitute a support for the memory of the doctores iuris, and seem to operate a visual correspondence between texts located in distinct volumes of the corpus iuris civilis, highlighting legal principles or doctrinal cases that the domini legum considered important for their teaching and theoretical studies. The language of the figurative and that of the normative statement thus seem to coordinate and be conceived for each other in a relationship of mutual enrichment, enhancement, actualisation and clarification.

Cette contribution analyse les illustrations du Corpus iuris civilis trouvées dans un groupe de manuscrits actuellement conservés dans la collection latine de la BnF et dans les nouvelles acquisitions latines. Ce corpus comprend une quarantaine de manuscrits enluminés autour des XIIIe et XIVe siècles en Italie du Nord, dans le sud de la France et en Catalogne. La contribution s'inscrit donc dans le champ de recherche consacré à l'iconographie juridique - " l'Art du droit " -, un champ disciplinaire auquel les historiens de l'art se sont jusqu'à présent principalement intéressés.L'examen de cet appareil d'illustrations d'un point de vue juridique montre comment les images peuvent se voir attribuer des fonctions multiples. En effet, elles ne se limitent pas à décorer le texte ou à constituer un "index visuel" utile structurant le corpus iuris, permettant au lecteur de s'orienter entre les différents livres qui le composent. D'une part, en effet, les images contribuent à la "sacralisation" du juriste, reflétant le rôle prépondérant qu'il avait fini par jouer dans la société de l'époque. D'autre part, en concrétisant l'abstraction verbale de la norme, les images constituent un support pour la mémoire des doctores iuris, et semblent opérer une correspondance visuelle entre des textes situés dans des volumes distincts du corpus iuris civilis, mettant en évidence des principes juridiques ou des cas doctrinaux que les domini legum considéraient comme mportants pour leur enseignement et leurs études théoriques. Le langage de la figuration et celui de l'énoncé normatif semblent ainsi se coordonner et se concevoir l'un pour l'autre dans un rapport d'enrichissement mutuel, de mise en valeur, d'actualisation et de clarification.
