The study of environmental protection as a component of the general interest leads to a more global research on the space assigned to environmental issues in French public law. Moreover, it is worth noting how public authorities approach the objective of protecting the environment and the means they deploy to achieve it. In accordance to the law of July 17, 1976 which relates to the protection of nature, the protection of the environment is recognized as a component of the general interest and deploys, within this framework, the means attached to such a status. The law thus explicitly establishes the legitimacy of the objective of protecting the environment. This first assessment makes it possible to consider the effects of the recognition of the general interest attached to protecting the environment. Environmental protection is thus a legitimate aim, in particular justifying the limitation of fundamental rights. Despite this status recognized as being of general interest, there is a certain discrepancy that arises when observing the implementation of reaching the environmental protection objective. Unlike other components of the general interest, environmental protection undergoes special treatment, a somewhat downgrading. The secondary nature of the environmental protection objective disrupts, even undermines, its ability to be achieved. The identification of a particular relationship between environmental protection and the logic of development, which is predominant in society, explains this observation. In light of this second assessment, legal solutions can be considered in order to reaffirm the environmental component’s space in comparison with the other components of the general interest.

L’étude de la protection de l’environnement en tant que composante de l’intérêt général entraîne une recherche plus globale sur la place attribuée aux problématiques environnementales dans le droit public français.Plus particulièrement, il s’agit de relever comment les autorités publiques appréhendent l’objectif de protection de l’environnement et les moyens déployés pour servir cette finalité. Par la loi du 17 juillet 1976 relative à la protection de la nature, la protection de l’environnement est reconnue finalité d’intérêt général et déploie, dans ce cadre, les moyens attachés à un tel statut. La loi établit ainsi de manière explicite toute la légitimité de l’objectif de protection de l’environnement. Ce premier constat permet de considérer les effets produits par la reconnaissance de l’intérêt général attaché à la protection de l’environnement. La protection de l’environnement constitue ainsi une finalité légitime justifiant notamment l’encadrement des droits fondamentaux. En dépit de ce statut reconnu d’intérêt général, un certain décalage est mis à jour quant à l’observation de la mise en œuvre de l’objectif de protection de l’environnement. À la différence des autres composantes d’intérêt général, la protection de l’environnement subit un traitement particulier, un certain déclassement. Le caractère ainsi secondaire de la l’objectif de protection de l’environnement perturbe voire remet en cause sa réalisation. L’identification d’un rapport particulier de la protection de l’environnement à la logique de développement, prédominante dans la société l’explique cette observation. Face à ce second constat, des solutions juridiques peuvent être envisagées afin de réaffirmer la place de la composante environnementale parmi les différentes finalités d’intérêt général.
