Dans cet article, nous chercherons à questionner la problématique du sens de la peine en rapport avec le crime et à l’incarcération. De la peine privative des libertés à la réinsertion sociale, la peine semble avoir « refoulé » son deuxième objectif, à savoir l’amendement du coupable, voire la régénération morale. Qui plus est, dans le champ judiciaire, l’introduction de l’individualisation des peines semble avoir complètement offusqué et occulté la question de la singularité de ces dernières. Ainsi, suite à un bref rappel historique, nous indiquons à quel point la clinique en milieu carcéral nous montre cet échec : la perdition des personnes détenues, quant au sens à donner à leur condamnation – si elle a eu lieu –, à leur incarcération et surtout à leur peine, est patente. Entre le non-sens, l’énigme et l’impossible, deux questions majeures constituent la trame de fond de notre travail : qu’est-ce qu’un crime et qu’est-ce qu’une peine ? ; qu’est-ce que la clinique en milieu carcéral nous apprend sur le crime et sur la peine en se situant dans cet interstice ?

In this article, we will seek to examine the question of the meaning of punishment in relation to crime and incarceration. From the punishment of deprivation of liberty to social reintegration, the sentence appears to have “repressed” its second objective, namely the amendment of the offender, or even moral regeneration. Moreover, in the judicial field, the introduction of the individualization of sentences seems to have completely obscured the question of the singularity of sentences. Thus, following a brief historical review, we indicate the extent to which clinical practice in prison demonstrates this failure: the loss of detainees, with regard to the meaning given to their conviction –if they have been convicted–, to their incarceration, and especially to their sentence, is obvious. Between the nonsense, the enigma, and the impossible, two major questions form the basis of our work: What is a crime and what is a punishment? And what does clinical practice in prison teach us about crime and punishment, situated as it is in the gap between the two?
