Le Conseil constitutionnel a joué ces dernières années un rôle croissant en matière fiscale. Il a censuré plusieurs dispositions ayant pour effet de créer certains impôts ou sanctions disproportionnés. Il a veillé à ce que la loi fiscale soit suffisamment claire et précise. Il a entamé un contrôle accru de sa rétroactivité. On peut encore espérer de substantielles avancées protectrices des droits fondamentaux du contribuable, notamment en matière de sanctions fiscales ou de respect des capacités contributives, mais la jurisprudence s’oriente dans la bonne direction.

A View of the Fiscal Jurisprudence of the Constitutional CouncilIn recent years, the Constitutional Council has played an increasing role in fiscal matters. It has censured several provisions whose consequence was to create certain taxes or disproportionate sanctions. It has ensured that the fiscal law remain sufficiently clear and precise. It has introduced a greater control of its retroactivity. There is still room for substantial progress in the protection of the taxpayer’s fundamental rights, notably regarding fiscal sanctions or the respect of contributory capacities, but the jurisprudence is moving in the right direction.
