Au Burundi, la justice de proximité des sages bashingantahe n'est pas reconnue par l'État. Pourtant, les justiciables ne s'en détournent pas. Surtout, une coopération spontanée existe bel et bien entre cette intuition traditionnelle et la justice étatique et une interaction à double flux existe entre ces deux systèmes. La question de la reconnaissance par l'État est envisageable mais délicate à deux égards : sa position de principe devrait être revue et la crainte d'une appropriation politique de ce phénomène spontané et vivace persiste.

In Burundi, the local justice rendered by the bashingantahe or wise men is not officially recognised by the State. And yet, people seeking justice have not turned away from it. Above all, there is actually a spontaneous form of cooperation between this traditional intuitive justice and State justice, and a two-way interaction exists between the two systems. The question of State recognition could be envisaged, but is a delicate matter on two counts: its official position would have to be reviewed and a fear remains of political appropriation of this spontaneous and very much living phenomenon.
