La loi du 4 mars 2002 a introduit dans le code de la santé publique un article L. 1111-1 qui de manière ambiguë lie les deux notions de responsabilité et de responsabilisation du patient. Ce texte pose ainsi les fondements de la mise en jeu de la responsabilité d’un patient qui n’adopterait pas un comportement vertueux pour sa santé. En raison des effets pervers souvent mis en évidence de la responsabilité financière du patient, ne serait-il pas opportun, à l’occasion de la prochaine loi de santé publique, de réécrire ce texte en dissociant ces deux concepts et en affirmant notamment que le patient ne saurait avoir une responsabilité envers lui-même ?
