The law or the legal system is itself in transition, in line with the foundational restructurings in our times. This transition definitely corresponds to the legal system’s emancipation from the boundaries of the national state as well as the frames of traditional public international law and the legal system’s global re-constitution as a functionally differentiated social system. One of the principal means through which this is taking place is definitely the new generation of international adjudication, distinguished by compulsory or quasi-compulsory jurisdiction, the involvement of non-state parties, interests and stakes, and its promising scope of application. It is also called full-fledged international adjudication as on a final analysis new generation of international courts and arbitral tribunals are capable to fulfill the functions of adjudication in the law. As known, in order to argue a probable change and to anticipate what such a change is going to deliver, attention should be first turned to the current structures, developments and challenges. Such a move is a precondition to grasp the whole picture of restructurings taking place in state, governance and law making. Such a move is a must to be able to re-locate or specify the law in the maps of global patterns of power and influence. The current structure, development and challenge to turn to is international adjudication, that is nothing but adjudication itself, re-loaded at the international level. New generation of international adjudication unprecedentedly contributes to the global re-constitution of the law as a functionally differentiated social system, enables a global legal system and truly denationalizes law and law making.

Le droit ou le système juridique est lui-même en transition, conformément aux restructurations fondamentales de notre époque. Cette transition correspond surement à l’émancipation du système juridique des frontières de l’État national ainsi que des cadres du droit international public et à la reconstitution globale du système juridique en tant que système social fonctionnellement différencié. L’un des principaux moyens par lesquels elle se déroule est certainement « la nouvelle génération de contentieux international », qui se distingue par la juridiction obligatoire/quasi obligatoire, l’implication de parties, intérêts et enjeux non-étatiques et son champ d’application. Je l’appelle aussi le contentieux international « à part entière » dans la mesure où, en dernière analyse, ces tribunaux internationaux sont capables de remplir les fonctions de contentieux dans le système juridique. Afin d’arguer un changement probable et d’anticiper ce qu’un tel changement va apporter, il faut d’abord se tourner vers les structures, les développements et les défis actuels. Une telle démarche est une condition préalable pour saisir l’ensemble des restructurations en cours dans l’État, le droit et la manière dont on élabore les normes juridiques. Une telle démarche est indispensable pour pouvoir spécifier le droit dans les cartes mondiaux de pouvoir et d’influence. La structure, le développement ou bien le défi actuel vers lequel on doit s’orienter est le contentieux international, le contentieux déployé au niveau international. La nouvelle génération de contentieux international permet la (re)constitution globale du système juridique ou la constitution d’un système juridique global et véritablement dénationalise le droit.
