Olivier Bachelet, « The Right to Choose One’s Death: The Ambiguities of the Strasbourg Court », Revue internationale de droit pénal, ID : 10670/1.rm03vn
Although the European Court of Human Rights refuses to deduce from the right to life "a diametrically opposite right, namely a right to die", the Court firmly confirms a right to choose one’s death as a result of the "personal autonomy" provided for in article 8 of the Convention. Nevertheless, the margin of appreciation granted to the member states in the implementation of this right qualifies its effectiveness without necessarily dispelling the fears related to the recognition of such a "negative right".
